Orford man sentenced for assault committed while out on bail

NORTH HAVERHILL — A 20-year-old man who had faced multiple felony counts of sexual assault against an underage 17-year-old female has pleaded guilty to a lesser charge of simple assault.

However, as part of the plea deal, Noah Schwarz, of Orford, received an enhanced prison sentence for the assault because he committed the crime while already out on bail in a prior sex assault case.

Judge Lawrence MacLeod sentenced Schwarz to a total of two years in prison, according to sentencing documents dated May 23 entered into the court docket in Grafton County Superior Court.

All but 27 days of the two years is suspended because Schwarz received credit for time served in pretrial confinement. Schwarz was released from Grafton County House of Corrections on the same day he was sentenced, Corrections Department records show.

The second year of potential prison time is an added penalty because Schwarz committed the assault while out on bail in connection with a prior alleged sex assault earlier last year.

Schwarz must successfully complete a court-ordered sex offender treatment program and an alcohol and drug abuse counseling evaluation in order to avoid risk of further jail time, records show. He also is ordered to have no contact with the victim.

In the earlier case, Schwarz was charged in June 2024 with sexually assaulting a 14-year-old female that May.

He was out on bail on those charges when he was charged in November with committing multiple counts of aggravated felonious sexual assault in October against a 17-year-old female, according to court records.

On Nov. 22, he pleaded guilty to a single count in the June sex assault charge involving a 14-year-old female and was sentenced to 12 months in jail, with all but 33 days suspended, and placed on probation for two years, court records show.

Other charges of simple assault and felonious sexual assault were dropped.

In February, Schwarz’ attorney filed notice with the court that if her client’s case in the October incident involving a 17-year-old female were to go to trial, he may claim a “defense of consent ... in that he was justified in his conduct because the alleged victim consented to said conduct.”

The three charges of aggravated felonious sexual assault from October were subsequently dropped under the plea agreement, according to court records.
